2. Description of Service
SORVA is a comprehensive Swiss wealth simulation, retirement planning, and tax optimization platform. The Service provides:
Lifetime income and wealth trajectory simulations.
Pillar 2 (BVG) and Pillar 3a projection tools.
Canton-specific tax optimization scenarios (calibrated specifically for ZH, BS, BL, AG; other cantons may use federal approximations).
"What-if" scenario planning for life events (e.g., Early Retirement, Property Purchase, Sabbatical).
Simulated insights on potential tax optimizations and generic asset allocation trajectories.
3. User Responsibilities & Security
You agree to:
Provide accurate information: The quality of the simulation depends entirely on the data you enter.
Secure your credentials (CRITICAL):
SORVA utilizes Client-Side Encryption (Zero-Knowledge Architecture). Your password generates the encryption key for your data.
WE CANNOT RESET YOUR PASSWORD. If you lose your password or recovery key, your data is permanently lost. SORVA accepts no liability for data loss resulting from lost credentials.
Use the Service in compliance with all applicable Swiss laws.
Not share your account credentials with third parties, except via explicitly authorized "Advisor Handshake" features.
4. Disclaimer of Financial Advice and Regulatory Status
Important Notice:
No Regulated Financial Service (FinSA / FIDLEG): SORVA is a deterministic calculation software, not a licensed financial institution. The Service does not broker, evaluate, or recommend specific financial instruments (such as specific ETFs, funds, or securities). Therefore, the Service does not constitute investment advice or a financial service under the Swiss Financial Services Act (FinSA / FIDLEG).
No Tax Rulings: Tax projections are estimates based on currently available federal, cantonal, and municipal multipliers. They do not constitute legally binding tax rulings. SORVA is not liable for changes in tax law or discrepancies in municipal tax calculations.
No Fiduciary Duty: Use of the Service does not create a fiduciary, advisory, or mandate relationship. All projections are hypothetical estimates. You must consult a certified tax expert or licensed financial advisor before executing legal, tax, or investment decisions. SORVA is not responsible for any financial losses, tax penalties, or missed opportunities resulting from the use of this Service.
5. Specific Terms for Professional / B2B Users
If you use SORVA on behalf of a business, as a financial advisor, fiduciary, planner, or HR professional ("Professional User"):
Sole Responsibility: You, the Professional User, retain full and sole regulatory responsibility (including FINMA/FinSA compliance, suitability, and appropriateness tests) for any advice given to your end-clients.
Verification Duty: You are strictly obligated to independently verify all mathematical outputs, tax estimates, and solvency projections generated by SORVA before presenting them to a client.
Indemnification: You agree to fully indemnify and hold Shreevya GmbH harmless against any claims, damages, or lawsuits brought by your end-clients or regulatory bodies resulting from your use of SORVA's reports or software.
6. Data Privacy & Zero-Knowledge Architecture
Your use of the Service is governed by our Privacy Policy.
Compliance: We process data in accordance with the Swiss Federal Act on Data Protection (revFADP) and GDPR.
Encryption: You acknowledge that your detailed financial data is encrypted on your device. SORVA technical staff cannot access or decrypt this data to provide support regarding specific calculation discrepancies or portfolio details.
7. Subscriptions, Fees & Beta Access
Private Beta / Evaluation Period: SORVA may initially be offered as a free Private Beta or evaluation version. During this phase, the Service is provided "as is" for testing and feedback purposes.
Future Commercialization: Shreevya GmbH reserves the right to introduce paid subscriptions, one-time audit fees, or premium tiers in the future.
Notice of Charges: You will never be charged automatically without your explicit consent. If a previously free feature becomes paid, you will receive prior notice and have the option to subscribe or securely export/delete your data. All paid fees are billed in advance and are non-refundable.
8. Intellectual Property
All content, calculation engines, code, and visual interfaces of the Service are the proprietary property of SORVA (or its licensors) and are protected by Swiss and international copyright, trademark, and intellectual property laws.
9. Limitation of Liability
To the maximum extent permitted by applicable Swiss law:
SORVA shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
SORVA shall not be liable for any loss of data due to user error (e.g., lost password) or technical failure.
In no event shall our total liability exceed the amount you paid to us (if any) for the Service in the past 12 months.
10. Service Availability
We strive to provide continuous service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues. We are not liable for any inconvenience caused by downtime.
11. Modifications to Terms
We reserve the right to modify these terms at any time. Significant changes will be communicated via email or platform notification. Your continued use of the Service after changes constitutes acceptance of the modified terms.
12. Termination
We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Switzerland.
Jurisdiction: Any disputes arising from these Terms shall be resolved exclusively in the courts of the Canton of Aargau, Switzerland (the seat of Shreevya GmbH).
